Got an FTA Penalty? How the Reconsideration and Escalation Process Actually Works
When unexpected tax fine lands, filing an FTA penalty reconsideration is your formal legal remedy. The common instinct is either to pay it immediately to make it go away, or to assume nothing can be done about it. Neither instinct is quite right. There’s a formal process for challenging an FTA decision, it has real deadlines, and it has at least one rule that catches people out badly if they don’t know it going in.
How to File an FTA Penalty Reconsideration: your first option
Under the UAE’s Tax Procedures Law (Federal Decree-Law No. 28 of 2022), submitted an FTA penalty reconsideration request allows you or your legal representative can submit a Reconsideration Request to the FTA asking it to review all or part of a decision — a penalty, an assessment, a registration ruling, whatever triggered it. You have 40 days from the date of the decision to file an FTA penalty reconsideration with valid factual and legal grounds.
The request has to set out valid grounds; a general objection that the penalty feels unfair won’t move it, a specific factual or legal basis will. The FTA then has 45 business days to review it, plus a further 5 business days to notify you of the outcome — so realistically, budget two to two-and-a-half months for a first answer.
FTA Penalty Resolution & Escalation Roadmap
| Resolution Stage | Legal Deadline | Key Requirement/ Ground Rule | What Happens If Missed? |
| 1. FTA Reconsideration Request | 40 Days from notice date | Specific factual evidence & legal ground (no emotional pleas) | Right to review expires; penalty becomes final. |
| 2. FTA Internal Review | 45 Business Days (+5 days notification) | Case reassessed by the Fedral Tax Authority | Decision upheld, reduced, |
| 3. Tax Disputes Resolution Committee | Within strict appeal window | Critical: Must pay full disputed tax & penalties upfront | Case rejected without hearing; assets open to recovery |
| 4. Judicial Appeal (Courts) | Escalation ceiling | Fromal legal litigation under UAE courts | rarely reached; costly without verfied prior grounds. |
The rule that surprises people
If the FTA rejects your reconsideration request, or doesn’t respond in time, the next step is escalating to the Tax Disputes Resolution Committee under the Ministry of Justice. Here’s the part that catches businesses out: before you can escalate, you generally have to pay the disputed tax and penalty in full. Disputing a decision doesn’t pause your obligation to settle it. Plenty of business owners assume a dispute in progress buys them time on payment — it doesn’t, and finding that out midway through a dispute is a bad place to discover it.
What happens at the Committee, and beyond
The Committee hears both sides and is required to issue a verdict within 20 business days, extendable by another 20 if needed — so a realistic ceiling of around eight to nine weeks once a case is properly before it. If either side disagrees with the Committee’s decision, it can be appealed further, to the courts. In practice, very few disputes go that far — most resolve or get abandoned well before a courtroom is involved — but it’s worth knowing the ceiling exists.
What actually makes a reconsideration request work
The FTA isn’t looking for a well-written complaint. It’s looking for a specific, evidenced reason the original decision was wrong — a factual error, a misapplied rule, a penalty calculated on the wrong basis, or circumstances that fall within a recognised exception. The strongest requests are narrow and evidenced, not broad and emotional.
If you’re sitting on an FTA penalty and unsure whether it’s worth challenging, that’s exactly the kind of conversation to have before the 40-day window closes, not after. Call or WhatsApp us.

Frequently Asked Questions on FTA Reconsideration
Q1: Can I submit an FTA penalty reconsideration after 40 days?
No, the 40-day deadline from the notification date is strictly enforced under Federal Decree-Law No. 28 of 2022. Late submissions are routinely rejected unless exceptional statutory relief applies.
Q2: Does submitting a reconsideration delay payment?
No. Disputing an assessment does not automatically stay the enforcement or requirement to pay the disputed liability.
Q3: What documents are required for an FTA appeal?
You must attach transaction proof, bank statements, tax returns, and a precise legal argument detailing factual or legal misinterpretations by the tax authority.
